GAMES AVAILABLE ON APPLE ARCADE
Your privacy is important to us, and we take our responsibility of caring for it seriously.
This Privacy Policy is specific to Fresh Planet’s game, SongPop Party offered on Apple Arcade. It describes what information FreshPlanet collects and how we use, disclose, transfer, and store it (when necessary). If you do not want FreshPlanet to collect, store, use or share your information in the ways described in this Privacy Policy, you may not be able to use our Services (as described below).
FreshPlanet, collects, stores, and uses your information as a data controller in connection with, and in order to provide and develop, FreshPlanet’s services and websites (together referred to as the “Services”) in accordance with this privacy policy (“Privacy Policy”).
All of our Services available on Apple Arcade, whether used on mobile devices, Mac or other platforms such as Apple TV, are governed by this Privacy Policy.
By using the Services, you hereby consent to this Privacy Policy.
This Privacy Policy is effective as of January 12, 2020.

1 – Information we collect, purposes and uses
Our game is available on Apple Arcade.
SongPop Party is an online music multiplayer game. Hence it requires players to access online resources/servers for the two following reasons:
Music repertoire
Online playing (In order to match players and keep track of their respective scores, you will need to connect to FreshPlanet's server).
We will ask your consent to share anonymous information with our server. Without your consent then you will not be able to access online music content. As a result, you will be limited to playing the offline tracks that are available in the game.
Also, if you do not give consent for sharing anonymous data, you will not be able to access online modes (Arena mode and online Party mode). If you do not give consent and want to access music playlists that are stored on our servers, we will prompt them with a consent explaining why we need this anonymous data.
While you play, you can export songs you like to your Apple Music Playlist. This requires an Apple Music subscription.
We collect only limited personal information:
For multiplayer (Party and Arena Mode). We need to know the alias of the player (used when you are playing online, to display your Game Center name to your matched opponent , the character and music selected end then answer for each question in real time during gameplay. We also need which song the player listened to during a quiz (except for offline mode) in order to give reporting for our music licenses.
Provide you with user support:
You can contact us by email but we may require you additional information depending your request (device type, IOs version).
If you decide to play offline or can’t access Internet, your player progress is stored on your device. As soon as you play online your player progress will be stored on Apple services, such as iCloud for game saves.
When you create or join a party game from tvOS, you will be presented with an option to invite more local players to the game (even if they do not have the SongPop Party App) using a QR code which is displayed on the screen.
Any other local player can join the game by scanning the QR code which will open the web browser with a custom web controller. The web controller acts just like a normal bluetooth controller but it connects directly to the game through the Songpop Party server.
Both web controller and host are connected to our backend via a socket connection. Local players’ data like character index, playlist info etc. is shared with the web controller for the sole purpose of proving the session. But at the end of the session, no local players ‘data is stored anymore on our systems.
2 – How we retain information- Deletion processes
For multiplayer gameplay, the information is not persisted on our servers, it is in memory of the server during that round of multiplayer and removed from memory once the game is over (a few minutes).
You can delete your game progress from iCloud at any time.
You can delete the information stored on your device (you have to uninstall the game).
3 – How we share information
We do not share any personal or non-personal information.
4 – Information Security
We
have implemented security measures to safeguard and help prevent
unauthorized access, maintain information security, and correctly use
anonymous information collected through the Services.
We
take, and force applicable third parties to take, reasonable
precautions to protect your anonymous information against loss,
misuse, unauthorized disclosure, alteration, and destruction.
However, please remember that no transmission of information over the
Internet or any wireless network can be guaranteed to be 100% secure.
5 – Changes to our Privacy Policy
We reserve the right to change this Privacy Policy at any time. In the event that we make material changes to this Privacy Policy, they will be re-posted in the "Privacy" section of our websites and apps with the date the modifications were made indicated at the top of the page. Therefore, please review this Privacy Policy from time to time so that you are aware when any changes are made to it. Your continued use of the Services after such change(s) constitutes your acceptance of any such change(s), and if you do not accept any changes, you may choose not to use the Services or opt out by sending us appropriate notice. If you would like further information about any recent changes made, please send your request to privacy@freshplanet.com and include “Information about Changes” in the subject line.
6 – Legal disclaimer
Our Services operate AS IS, and we do not represent or warrant that our Services will be available at all times, or that your use of the Services will be uninterrupted or error-free. We are not responsible for your ability to access the Services or for matters beyond our control. This Privacy Policy is governed by the laws of your country of residence. Any dispute arising from the use of the Services shall be submitted to the competent courts of your country of residence.
